2006 Survey Of ADR Providers |
In recent years, Massachusetts has experienced a boom in the number of parties looking for alternatives to traditional litigation — and in the number of organizations and individuals stepping up to provide those alternatives.
For the 12th year, Massachusetts Lawyers Weekly presents its annual survey of the many alternative dispute resolution providers that now exist throughout the commonwealth. These providers of mediation and arbitration options come in many different shapes, sizes and varieties and present a complicated menu of choices for attorneys interested in exploring the ADR option.
This special section — compiled from answers to questionnaires mailed out to organizations and arranged alphabetically — will hopefully provide a useful guide for readers in sorting through the multitude of options.

Message from the president: Over the past 15 years, alternative dispute resolution (ADR) has proven itself to be a far more cost-effective and timely alternative to protracted litigation. As a participant within this industry, we have continued to work with the plaintiffs' and defense bars to increase awareness of the benefits of utilizing ADR. In today's litigious society, the growth of ADR has offered the legal community a resolution alternative that benefits all parties.

Message from the president: I bring to the table 40 years of litigation experience, 25 years as an adjunct professor at Boston College Law School teaching dispute negotiations and trial practice evidence. In addition to the necessary quality of neutrality, I offer a calming atmosphere and flexibility in my approach so that all parties are comfortable in setting aside ego and other potential obstacles to reaching a satisfying resolution. Experience and the problem-solving nature of my personality, combined with my ability to analyze and assess the parties' underlying motivations, interests and priorities, are critical in facilitating resolution of differences and helping the parties achieve the primary objective of final settlement.

My styles of mediation and arbitration are designed to be flexible and tailored to the specific needs of the parties in dispute. Message from the president: My arbitration services are provided in an expedient manner in a comfortable setting for a reasonable fee. I have a proven history, based on my knowledge of the law and the court system, of providing mediation clients with a perspective they may not have considered, thereby making compromise more attractive and effectuating a satisfactory settlement. I have a grassroots understanding of analyzing cases for strengths and weakness both from a liability standpoint and for assessing value to injuries. I actively practiced law trying cases for plaintiffs, defendants and insurers from 1980-2002 with the law firm of Moriarty, Donoghue & Leja, where I was a partner from 1987 until I left to start my own ADR business in 2002. I have provided ADR services since 1985, and ran arbitrator training seminars for the American Arbitration Association, where I served on the Advisory Board. In 2001, the Massachusetts Defense Lawyers Association voted me "Defense Lawyer of the Year," at which time I left the active practice of law to start my own ADR business.

Message from the president: Attorneys with a variety of disputes find it easy to resolve their cases with us. Parties can resolve their disputes at JAMS even if another provider is written into the contract, and can select the rules they prefer. Our list of distinguished arbitrators and mediators is accessible on our website. We also take pride in our experienced, local case managers, who help you select the most appropriate neutral to resolve your dispute, and will seamlessly administer your case from beginning to end. If you have used JAMS, I thank you. If you haven't, I invite you to try us!
Mass. neutrals/total neutrals: 13/225
Disputes/specialties: Types: complex, multi-party and high-stakes arbitrations and mediations; subject matter/area types include, but are not limited to: business and commercial, class actions, construction, employment, environment, franchise, maritime, insurance, intellectual property, surety
Services provided: Mediation; Arbitration; Case Evaluation; Mini-Trials
Service areas: New England, United States, worldwide
Fee schedule: $300-$600
Income derived from ADR/mediation: 100%
Time devoted to ADR/mediation: 100%
No. of cases submitted annually: N/R (JAMS handles class actions and multi-party, complex cases. JAMS data concerning the number of cases is unique in counting class actions as one case rather than the thousands of disputes resolved by JAMS neutrals every year.)
Of cases submitted, no. actually mediated: N/R (The types of cases submitted to JAMS Boston Resolution Centers are not comparable to those submitted to other ADR providers. Disputes submitted to, and resolved by, JAMS tend to be more complex and typically entail longer sessions than less-complicated disputes such as personal injury cases and no-fault matters. JAMS primarily handles complex and/or multi-party matters, including some class actions that may involve hundreds of hearings but are counted in the JAMS statistics as one case.)
Of mediations, no. resulting in settlements: Based on past results, JAMS takes pride that almost all of the cases mediated, even the most complex ones, are successfully resolved
Average no. of days of mediation/ arbitration session: 1-2 days
Average no. of days from filing to resolution: N/R
Primary sources of ADR/mediation business: Law firms, in-house counsel
Other information: ADR Education: JAMS neutrals are frequent speakers, lecturers and CLE providers on a wide variety of timely ADR topics. Business Centers: JAMS provides business center facilities so clients can work productively and efficiently while they are in JAMS offices. JAMS Resolution Centers are professional and comfortable with complimentary food and beverages. Case Management: JAMS has created a state-of-the-art computerized case management system to enable clients to focus on the substantive issues in dispute. Case managers set the case, provide logistics and documentation, verify case information, provide confirmation and disclosure information to all parties. This system saves time and removes obstacles that might otherwise detract from the parties' ability to concentrate directly on resolving their disputes. Nationwide Network of Offices: With 23 Resolution Centers connected nationwide, the company and its more than 200 full-time neutrals are responsible for handling thousands of the nation's most important and complex cases. This nationwide network enables clients to receive consistent, high-quality service.

Message from the president: Since the company was founded in 1997, Legal Options has successfully provided mediation, arbitration and case evaluation services to attorneys, insurance companies, individuals and corporations throughout New England. With a distinguished panel of certified mediators and arbitrators, we offer expertise in most areas of civil practice, with concentration in complex and multi-party litigation. The skills and credibility of our panel members as neutrals are derived from a combination of extensive trial experience, years of ADR practice and teaching or training in the field of dispute resolution. This balanced approach and perspective has resulted in a mediation success rate exceeding 90 percent and, in my opinion, reflects the achievement and commitment of each panel member within the legal profession and the field of ADR. I am equally proud of the quality of our administrative services which I believe are unsurpassed in the industry.
